Terms of business

These are the terms that apply when you hire workers, have contracting work carried out or get help with recruitment from Bemandix. This is an English translation. If there is any discrepancy, the Danish version applies.

Effective from 15 October 2026

1. Scope

1.1 These terms of business apply to all services provided by Bemandix: labour hire, contracting and recruitment. Bemandix is run by Sahari, CVR 45468054, Kaj Munks Vej 31, 1. 2., 8260 Viby J (hereinafter "Bemandix").

1.2 The terms apply to business customers. If you are a consumer, the mandatory rules of consumer legislation take precedence over these terms, and for building and construction work the General Conditions for Building Work for Consumers (AB-Forbruger) apply.

1.3 What is stated in Bemandix's quote or order confirmation takes precedence over these terms. The customer's own purchasing or trading terms only apply if Bemandix has accepted them in writing.

2. Requests, quotes and agreement

2.1 A request made via the website, by telephone or by e-mail is non-binding for both parties.

2.2 A binding agreement has been entered into when the customer has accepted a quote from Bemandix in writing (e.g. by e-mail), or when Bemandix has confirmed an order in writing.

2.3 A quote is valid for 30 days, unless otherwise stated in the quote. The quote is based on the information and material provided by the customer. If the information proves to be incorrect or incomplete, Bemandix may adjust the price and timetable.

2.4 All prices are in Danish kroner and exclusive of VAT.

3. Labour hire

3.1 In labour hire, Bemandix makes workers available. The workers are employed by Bemandix or by one of Bemandix's approved partners, which is the employer and pays wages, tax and statutory insurance.

3.2 The customer directs and allocates the work and is responsible for the working environment at the workplace, including instruction, supervision, safety and necessary personal protective equipment, as follows from the working environment legislation (arbejdsmiljølovgivningen) for a company that uses hired-out workers.

3.3 The workers may only carry out the work that has been agreed and may not be lent to others without Bemandix's written consent.

3.4 The customer approves the workers' hours weekly. If the customer has not approved or objected to a timesheet within 3 working days, it is deemed to have been approved.

3.5 If a worker does not have the expected qualifications, or if there are other problems, the customer must notify Bemandix immediately. Bemandix will, as far as possible, make another worker available.

3.6 If the customer cancels a confirmed order later than 24 hours before the agreed start, the first working day will be invoiced, but no more than 8 hours per worker ordered.

3.7 If the customer wishes to employ a worker whom Bemandix has hired out or presented, within 6 months after the latest hire or presentation, the customer must notify Bemandix and pay a recruitment fee of 15% of the worker's gross pay for the first year. The fee covers Bemandix's costs of finding, selecting and introducing the worker. If the worker has been hired out to the customer for at least 6 consecutive months, no fee is payable. This provision does not limit the worker's right to take up employment.

4. Contracting

4.1 For building and construction work that Bemandix carries out as contracting work for business customers, AB 18 (General Conditions for Works and Supplies in Building and Construction – Almindelige betingelser for arbejder og leverancer i bygge- og anlægsvirksomhed) applies, unless otherwise agreed in writing.

4.2 The price covers what is stated in the quote. Changes and extra work that the customer requests, or that are necessary due to circumstances that were not known at the time of the quote, are carried out by agreement and charged separately.

4.3 The customer shall ensure that Bemandix has access to the workplace and – unless otherwise agreed – access to electricity, water and waste handling.

4.4 Bemandix may have the job carried out in whole or in part by approved partners. Bemandix remains the customer's contracting party and is liable to the customer.

5. Recruitment

5.1 In recruitment, Bemandix finds, selects and presents candidates whom the customer employs itself. The fee and the time of payment are stated in the quote. Unless otherwise agreed, the fee falls due when the candidate has accepted the employment.

5.2 If, within 12 months after the presentation, the customer employs a candidate whom Bemandix has presented – also in a different position – the customer shall pay the agreed fee.

5.3 The customer is the employer of the person employed and is responsible for the employment relationship. Bemandix is not liable for the candidate's work performance after the employment has begun. Any guarantee only applies if it is stated in the quote.

6. The customer relationship and partners

6.1 Bemandix introduces the customer to workers and partners as part of Bemandix's services. If, within 12 months after the latest job, the customer enters into an agreement directly with a partner introduced by Bemandix for similar services without going through Bemandix, the customer shall pay an introduction fee (formidlingshonorar) of 20% of the value of the direct agreement in the first 12 months. This does not apply if the customer can document a customer relationship with the partner that pre-dates Bemandix's introduction.

7. Prices, invoicing and payment

7.1 Surcharges for overtime, work in the evenings, at weekends and on public holidays, as well as travel and materials, are charged in accordance with the quote.

7.2 Labour hire is invoiced on an ongoing basis on the basis of the approved hours. Contracting work is invoiced according to the agreed payment schedule or in accordance with AB 18. Recruitment is invoiced when the fee falls due.

7.3 The payment term is 14 days net from the invoice date, unless otherwise agreed.

7.4 In the event of late payment, default interest and compensation are charged in accordance with the Danish Interest Act (renteloven). If the customer does not pay after a written demand for payment, Bemandix may suspend deliveries until payment has been made.

8. Complaints and liability

8.1 The customer must make any complaint in writing without undue delay after the customer has become aware, or ought to have become aware, of a matter, and no later than 8 days thereafter. For contracting work, the provisions of AB 18 on defects apply.

8.2 Bemandix is liable under the general rules of Danish law, subject to the limitations that follow from these terms. In labour hire, Bemandix is responsible for making workers with the agreed qualifications available, but not for the result of work carried out under the customer's direction.

8.3 Bemandix is not liable for operating losses, loss of profit, loss of data or other indirect losses. Bemandix's total liability for a job is limited to the amount Bemandix has invoiced for the job. The limitations do not apply in the event of intent or gross negligence.

8.4 Bemandix is not liable for delay or failure to deliver caused by circumstances beyond Bemandix's control (force majeure), e.g. strikes, lockouts, extreme weather conditions, epidemics or orders from public authorities.

9. Confidentiality and personal data

9.1 The parties shall treat information about each other's business affairs as confidential.

9.2 If the customer receives personal data about workers or candidates, it may only be used for the agreed job. The customer is independently responsible for processing it in accordance with the data protection rules and must delete data about candidates who are not employed when it is no longer necessary. See also our privacy policy.

10. Governing law and disputes

10.1 Agreements with Bemandix are governed by Danish law.

10.2 Disputes that cannot be resolved by negotiation are settled at Bemandix's home venue (hjemting) as the court of first instance. Disputes about contracting work under AB 18 are settled in accordance with the rules in AB 18.

11. Changes

Bemandix may change the terms. Changes apply to agreements entered into after the amended terms have been published here on this page.
